Privacy Policy
Effective June 10, 2026. Draft pending review by Recalde Law Firm, P.A.
This Privacy Policy describes how information is collected, used, and protected on this website (the "Site"), operated for Recalde Law Firm, P.A., 1111 Brickell Avenue, 10th Floor, Miami, FL 33131 (the "Firm", "we", or "us"). We take the privacy of people in financial distress seriously: visiting this Site is itself a sensitive act, and we treat it that way.
1. Information we collect
Information you provide. When you submit the "Get a callback" form or contact us, we collect the information you enter: your name, phone number, email address, a category describing your situation (for example garnishment or foreclosure), and your consent to be contacted. If you use the client intake portal linked from this Site, the information you provide there is governed by the portal's own privacy notice in addition to this one.
Information collected automatically. Like most websites, our hosting infrastructure logs basic technical data such as IP address, browser type, pages requested, and timestamps, used for security and operations. This static Site does not set advertising cookies and does not run third-party ad trackers.
2. How we use your information
We use the information you submit for one purpose: responding to your request and evaluating whether the Firm can help you. That includes calling or messaging you back at the number you provide, emailing you, and preparing for a consultation. We also use technical log data to keep the Site secure and functioning.
3. Who processes your information
We use a small set of service providers to operate this Site and route your requests, each acting on our behalf:
- Netlify, which hosts this Site and its infrastructure logs.
- Lead routing to the Firm's intake system. Form submissions are transmitted to the Firm's secure intake system so the team can follow up with you.
- Resend, an email delivery service used to send notification and follow-up emails related to your request.
These providers receive only what they need to perform their function and are not permitted to use your information for their own purposes.
4. What we do not do
We do not sell your personal information. We do not rent or trade it. We do not share it with data brokers or marketing list companies. Information you submit about your financial situation is used to respond to you, and for no other commercial purpose.
5. Retention
We keep callback requests and related correspondence for as long as needed to respond to you and for a reasonable period afterward for recordkeeping, typically no longer than two years for inquiries that do not become engagements. If you become a client, your information is retained under the Firm's client file retention policies and applicable Florida Bar rules. Hosting logs are retained on short rotation by our infrastructure provider.
6. Security and the Florida Information Protection Act
We use reasonable technical and organizational measures to protect personal information, including encryption of data in transit. As a Florida operation, we take our obligations under the Florida Information Protection Act, Fla. Stat. § 501.171, seriously: in the event of a data breach affecting your personal information, we are committed to investigating promptly, notifying affected individuals and the Florida Department of Legal Affairs within the timeframes the statute requires, and taking corrective action.
7. Your rights and choices
You may contact us at any time to ask what information we hold about your inquiry, to correct it, or to ask us to delete it, subject to records we are required to keep by law or professional rules. You can opt out of follow-up communications by telling us so in any reply, or by calling the office. To exercise any of these rights, contact Recalde Law Firm, P.A., 1111 Brickell Avenue, 10th Floor, Miami, FL 33131, (305) 792-9100.
8. Children
This Site is not directed to minors, and we do not knowingly collect personal information from anyone under 18. If you believe a minor has submitted information through this Site, contact us and we will delete it.
9. Privilege and confidentiality note
Submitting information through this Site does not create an attorney-client relationship, and information submitted before an engagement is established may not be protected by attorney-client privilege. Please do not include detailed confidential information in a callback request; a name, contact details, and a general category are enough for us to reach you.
10. Changes to this policy
We may update this Privacy Policy from time to time. The effective date above reflects the latest revision, and material changes will be posted on this page.
